Because of default in the payment of the indebtedness, secured by a Security Deed executed by Kathryn C. Aliffi to JPMorgan Chase Bank, N.A. dated October 13, 2009 in the amount of $181,400.00, and recorded in Deed Book 1145, Page 455, Lumpkin County, Georgia Records; as last transferred to JPMorgan Chase Bank, National Association by assignment; the undersigned, JPMorgan Chase Bank, National Association pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in February, 2013 , during the legal hours of sale, at the Courthouse door in Lumpkin County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:

The property shall not be used for any commercial purposes. However, home gardens, noncommercial greenhouses, noncommercial livestock and poultry, and shelters for a maximum of Three (3) household pets shall be permitted provided no building or enclosure for the maintenance or shelter of animals shall be located within Three (300) feet of any private residence other than that of the owner.

Garages and other accessory buildings shall be permitted provided they are located in the rear yard and comply with all setback requirements for the primary dwellings as listed above. Grantor covenants, for himself, his heirs and assigns, to include the provisions of these restrictive covenants in the deeds for any property which is subsequently sold on Robinson Road. These covenants shall run with the and be binding on all parties hereafter owning and acquiring land along said road, their assigns, administrators, heirs and executors and all persons claiming under them for the full period of Twenty (20) years from June 1, 1979, and at the expiration of said period, said covenants shall be automatically extended for successive periods of Ten (10) years unless modified by an instrument signed by a majority of the then-owners of lots which are subject to these covenants, with such modifications only becoming effective if recorded in the Office of the Clerk of Superior Court, Lumpkin County, Georgia.
